IP Protection of AI-Generated Products and Conflict of Laws Analysis on their Cross-Border Aspects: A Japan-Türkiye Comparative Analysis
Proje adı: IP Protection of AI-Generated Products and Conflict of Laws Analysis on their Cross-Border Aspects: A Japan-Türkiye Comparative Analysis
Proje konusu: This research project, titled “IP Protection of AI-Generated Products and Conflictof-Laws Analysis on their Cross-Border Aspects: A Japan-Türkiye Comparative Analysis,” explores how Japanese and Turkish legal systems address the challenges posed by AI-generated content within intellectual property (IP) and private international law (PIL) frameworks. As AI increasingly produces works such as software, art, inventions, and designs without direct human involvement, traditional IP principles-especially authorship and inventorship-are being tested. The study investigates whether such AI-generated products are eligible for protection under Japanese and Turkish copyright, patent, and design laws, and how cross-border disputes involving these works are resolved. The research is guided by four key questions: (1) Are AI-generated products eligible for IP protection in Japan and Türkiye? (2) What legal challenges arise in attributing authorship or inventorship to non-human creators? (3) How do both countries’ PIL rules determine jurisdiction, applicable law, and enforcement in cross-border disputes? (4) Can comparative insights support legal harmonization and cooperation in international AI governance? By comparing Japan’s hybrid legal system with Türkiye’s civil law tradition, this research aims to foster mutual legal understanding and propose practical legal and policy recommendations for regulating AI-generated content in a global context.
